Switzerland is outside the EU and applies its own revised Federal Act on Data Protection, in force since September 2023, overseen by the FDPIC. A key difference from the GDPR is that Swiss fines target responsible individuals rather than companies and are capped at 250,000 Swiss francs. The revFADP follows an opt-out logic for many processing activities, which means cookie consent is generally less strict than under the GDPR, although consent is still needed for sensitive data and profiling. Privacy notices are expected and the law applies extraterritorially to processing affecting people in Switzerland. Many Swiss sites still adopt GDPR-style banners to cover EU visitors.
