PIPEDA Compliance with ConsentX

PIPEDA, the Personal Information Protection and Electronic Documents Act, is Canada's federal private-sector privacy law governing the collection, use and disclosure of personal information in commercial activities.

Meaningful consent means individuals should reasonably understand what they are agreeing to, including the nature, purpose and consequences of collecting, using or disclosing their personal information.

PIPEDA generally applies to private-sector organizations that collect, use or disclose personal information in the course of commercial activities in Canada, subject to applicable provincial legislation and exceptions.

Consent is one of PIPEDA's core principles. Organizations generally need knowledge and consent for the collection, use or disclosure of personal information, except in circumstances where consent is not appropriate or required by law.

PIPEDA is not simply a cookie-consent law. Its requirements apply to the collection, use and disclosure of personal information. Where cookies and tracking technologies involve personal information, organizations should assess their privacy practices and consent requirements in context.

Individuals generally have the right to request access to personal information held about them, understand how it is being used or disclosed, and challenge its accuracy and completeness.

In applicable circumstances, individuals can withdraw consent, subject to legal or contractual restrictions and reasonable notice. Organizations should clearly explain the implications of withdrawing consent.

ConsentX provides technology that can support important privacy and consent operations, including meaningful consent, purpose-based choices, tracker discovery, script controls, consent evidence and access-request workflows. However, using ConsentX alone does not guarantee PIPEDA compliance. Organizations should assess their complete privacy program and specific obligations with qualified counsel.
