Who Does the FDBR Apply To?
The FDBR applies to certain for-profit entities that conduct business in Florida, collect or process Florida consumers' personal data, and meet specific statutory requirements.
The law generally covers entities with more than $1 billion in global gross annual revenue that also satisfy at least one specified condition, including deriving at least 50% of global gross annual revenue from online advertising, operating a consumer smart speaker and voice-command service with an integrated virtual assistant, or operating an app store or digital distribution platform offering at least 250,000 software applications.
The FDBR also contains specific exemptions for entities and information regulated under laws such as GLBA and HIPAA, as well as certain government, nonprofit, and educational entities.
