Who Does the OCPA Apply To?
The OCPA generally applies to businesses that conduct business in Oregon or provide products or services to Oregon residents and meet specified data-processing thresholds.
Generally, the law applies to businesses that control or process the personal data of 100,000 or more consumers during a calendar year, or 25,000 or more consumers while deriving at least 25% of annual gross revenue from selling personal data, subject to statutory exemptions.
The OCPA also includes specific provisions applicable to certain nonprofit organizations and additional protections for children and teens.
