Who Does the TDPSA Apply To?
The TDPSA generally applies to businesses that conduct business in Texas or produce products or services consumed by Texas residents and process consumers' personal data, subject to statutory applicability requirements and exemptions.
Small businesses are generally exempt, except that a small business that sells sensitive data must obtain the consumer's consent before doing so. Certain regulated entities, government bodies, nonprofits, and other categories are also subject to specific exemptions under the Act.
